Will apple still give me a new iphone?

im going to sell mine, and its cracked and ive been told theyll give me a brand new one if ive had it less than a year..i have. but i dont have service with at&t anymore..will they still give me a new phone? of course i wouldnt tell them im going to sell it, id say i still use the ipod and wifi...but still...will they?
