Default I know you can switch SIM cards throughout cingular phones, but...?

if you were to have a phone which is under contract, but it crashed and is no longer functional, and want to buy a used phone and simply put in your sim card, would that break the contract or mess up the contract or do anything to nullify the contract? please help me with this matter.
